Evo LOVE Terms & Conditions

Set out below are evo’s (for Evo Labs Pty Ltd and its related entities) terms and conditions (Terms) in relation to the ‘Love’ salon rewards program (Love), as described in the Love Brochure. Love is being operated by Privity Pty Ltd (trading as Haircare Group) (HCG) in Australia. The brochure describes qualifications for membership, membership levels, rewards, education and other benefits based on monthly spend.

By applying online at https://thehaircaregroup.com/evo-love-program/ or through your HCG sales representative and participating in the Love program, you are taken to have read and agreed to these Terms.

Rewards and Redemption

Love salons may redeem quarterly rewards based on your Love level and purchases provided that you meet Love qualifications and redeem rewards within 30 days of rewards voucher issue.

Benefits

Love salons may access the benefits detailed in the Love brochure as current from time to time dependent on Love level.

Data and Privacy

All personal details provided to and collected by HCG will be kept confidential and only used in accordance with HCG’s privacy policy and all applicable data collection and privacy legislation.

Marketing Communications

evo and HCG may send promotional and marketing communications about Love, products and education to your nominated email, phone and/or physical addresses. You may opt-out of receiving marketing communications at any time by clicking on the unsubscribe link within the marketing materials you receive or by contacting us at salesupport@haircare.group

Online Sales and Diversion

You are not permitted to sell evo products online, unless you:

  1. carry on business as a “professional hair salon” that meets the following definition:
    (a) is a business entity where qualified hairdressers who are employees, independent contractors or booth renters perform hairdressing services, such as hair cutting, hair styling and hair colouring, at a government-licensed business location that has a street address;

    (b) has shampoo basins and styling chairs;

    (c) has at least one full time, qualified hairdresser on the premises regularly and customarily and must be performing services on patrons on the premises while the premises is open for business; and

    (d) has appearance indicating that the principal business is the performance of professional services on hair rather than the making of retail sales and must derive a substantial percentage of its revenue from the provision of hair care services (cutting, colouring, styling etc);

  2. have a salon website which includes:
    (a) the name of the salon in the name or the title of the website;
    (b) in the website menu the valid:
    i. location(s) of the salon;
    ii. the services offered by the salon (eg hair cutting, styling and colouring); and
    iii. the contact details of the salon for customer inquiries in respect of the salon’s products and services;
  3. make the full range of the products available for sale at the salon premises and salon website;
  4. only sell the products online from this salon website;
  5. professionally use and endorse the evo products at stylist station and at the salon basin; and
  6. have been expressly authorised by HCG to sell evo online on your salon website under an authorised online reseller agreement.

You are prohibited from:

(a) acting as a wholesale distributor or supplier of evo products to any party where it appears that party intends itself retail the products to end user consumers; and

(b) selling evo products on any third-party online marketplaces such as (but not limited to) Amazon, eBay or Facebook.

If it is brought to HCG’s attention that you are selling in breach of these Terms, your Love membership may be terminated and your account may be placed on stop supply or terminated by HCG and legal action may be taken for damages.

Modification

evo and HCG reserve the right to amend and update the Love program and these Terms at any time in its sole and absolute discretion. HCG will always use reasonable endeavours to provide notice to Love salons of any material changes to Love. However, you should still review these Terms frequently to ensure that you are aware of the current Terms that apply to Love.

Termination

If you decide that you no longer want to be a member of Love, you may cancel your membership at any time by emailing us at salesupport@haircare.group with your request. If you cancel your membership, you will automatically cease receiving all Love benefits.

evo or HCG may terminate your Love membership if:

(a) you breach these Terms, as determined by evo and/or HCG in its sole discretion;

(b) you breach the terms of your agreement with HCG; or

(c) if evo materially amends or ceases to operate the Love program.

Governing Law and Disputes

These Terms are governed by the law of South Australia and the parties to any dispute arising irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts of South Australia and the Commonwealth of Australia.
